By accessing and using SyncSymptom ("the Service," "the App," "we," "us," or "our"), you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SyncSymptom is a personal health tracking application that allows users to:

  • Log and monitor symptoms, activities, food intake, sleep, mood, and medications
  • Track health patterns and trends over time
  • Generate reports and summaries for healthcare providers
  • Identify potential triggers and correlations through data analysis
  • Access health tracking via web, mobile, and Telegram integration

The Service is designed as a personal tracking tool to help users monitor their health and communicate more effectively with healthcare professionals.

3. Medical Disclaimer and Limitation of Liability

The Service, including any patterns, insights, correlations, or suggestions it may present, does not constitute medical advice. We are not healthcare providers, and nothing in the Service should be construed as:

4. User Responsibilities

4.1 Account Security

  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong, unique passwords

4.2 Accurate Information

You agree to provide accurate, current, and complete information when using the Service. Inaccurate data may lead to misleading patterns or correlations.

By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you. This includes:

  • Storing your data securely on our servers
  • Processing your data to generate insights and patterns
  • Displaying your data back to you through the interface
  • Backing up your data for disaster recovery

5.3 Data Export and Deletion

  • Delete your account and all data at any time through account settings

Upon account deletion, all your personal data will be permanently deleted from our systems within 30 days, except where retention is required by law.

7. Third-Party Integrations

7.1 Telegram Integration

If you use our Telegram bot integration, data transmitted through Telegram is subject to Telegram's terms of service and privacy policy in addition to ours. We securely transmit your health data from Telegram to your SyncSymptom account but cannot control Telegram's data handling practices.

7.2 Future Integrations

We may offer integrations with calendar services (Google Calendar, Apple Calendar, etc.) and other third-party services. Use of these integrations is optional and subject to the third party's terms and privacy policies.

8. Service Availability and Modifications

8.1 No Guarantee of Availability

While we strive to provide continuous service, we do not guarantee that the Service will be available 100% of the time. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Circumstances beyond our control
  • Security incidents requiring service suspension

8.2 Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

8.3 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service, including but not limited to health outcomes, medical decisions, lost data, or lost profits.
  • Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless SyncSymptom, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any health or medical decisions you make based on the Service

11. Intellectual Property

11.1 Our Property

The Service, including its software, design, text, graphics, logos, and other content (excluding your personal data), is owned by SyncSymptom and protected by copyright, trademark, and other intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial use. You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer or decompile the Service
  • Remove any copyright or proprietary notices
  • Use the Service for commercial purposes without permission

12. Termination

You may terminate your account at any time through account settings or by contacting us. Upon termination, your data will be deleted as described in our Privacy Policy.

We reserve the right to suspend or terminate your account if:

  • Your account is used for fraudulent or illegal activities
  • You fail to pay any fees owed (if applicable)
